Agreement to Terms

Welcome to Metcalfe Resorts. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and Metcalfe Resorts ("we," "us," "our," "Hotel," or "Company") regarding your use of our website, services, and facilities located at 101 Metcalfe Street, Ottawa, Ontario, Canada.

By making a reservation, accessing our website, or using our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services or make reservations with us.

Reservation and Booking Terms

Reservation Requirements

To make a reservation, you must be at least 18 years of age and possess the legal authority to enter into this agreement. You are responsible for providing accurate, complete, and current information during the booking process. Any false, incomplete, or misleading information may result in the cancellation of your reservation without refund.

Payment Terms

Full payment or a deposit may be required at the time of booking, depending on the rate selected and length of stay. We accept major credit cards including Visa, MasterCard, American Express, and Discover. Additional charges, including taxes, resort fees, and incidental charges, may apply and will be clearly disclosed during the booking process.

Standard Rates

Cancellations must be made at least 24 hours before the scheduled arrival date to avoid charges for the first night's accommodation.

Special Packages

Non-refundable rates and special packages may have different cancellation policies, which will be clearly stated at the time of booking.

Important Cancellation Policy

Cancellations made less than 24 hours before arrival, or failure to arrive (no-show), will result in a charge equivalent to one night's accommodation plus applicable taxes. Holiday periods and special events may have extended cancellation periods.

Check-in and Check-out Policies

Standard check-in time begins at 4:00 PM, and check-out is required by 11:00 AM. Early check-in and late check-out are subject to availability and may incur additional charges. We reserve the right to release rooms if guests have not arrived by 6:00 AM the following day, unless prior arrangements have been made or guaranteed with a valid credit card.

Guest Registration

All guests must register upon arrival and present valid government-issued photo identification. The guest whose name appears on the reservation must be present during check-in and will be held responsible for all charges incurred during the stay, including those made by additional occupants of the room.

Guest Conduct and Responsibilities

Guests are expected to conduct themselves in a respectful and appropriate manner throughout their stay. The following activities are strictly prohibited:

  • Smoking in non-designated areas (a cleaning fee of $500 will be assessed for smoking violations)
  • Excessive noise or disruptive behavior that interferes with other guests' enjoyment
  • Unauthorized pets (except registered service animals)
  • Illegal drug use or excessive alcohol consumption
  • Weapons or dangerous items on the premises
  • Exceeding the maximum occupancy limits for guest rooms
  • Commercial or promotional activities without prior written consent

Damage and Liability

Guests are responsible for any damage to hotel property caused during their stay, whether intentional or accidental. Repair or replacement costs will be charged to the credit card on file. The hotel is not responsible for lost, stolen, or damaged personal property. We recommend guests utilize in-room safes and carry appropriate travel insurance.

Hotel Amenities and Services

While we strive to maintain all advertised amenities and services, the availability of certain facilities may be subject to seasonal closure, maintenance requirements, or operational needs. We reserve the right to modify, suspend, or discontinue any service or amenity without prior notice, though we will make reasonable efforts to inform guests of significant changes.

Parking

Valet parking is available for an additional fee. The hotel is not responsible for damage to or theft from vehicles, regardless of whether parking services are provided by the hotel or third-party operators. Guests park at their own risk.

Privacy and Data Protection

Your privacy is important to us. Information collected during the reservation process and your stay is governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also consent to our collection, use, and disclosure of your personal information as outlined in our Privacy Policy.

Force Majeure

Neither party shall be liable for any failure to perform their obligations under these Terms if such failure is due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, labor disputes, or public health emergencies. In such circumstances, we will work with guests to provide reasonable alternatives or remedies when possible.

Limitation of Liability

The hotel's liability to guests is limited to the amount paid for accommodation. We shall not be liable for indirect, incidental, special, or consequential damages arising from your stay or use of our services. This limitation applies regardless of the legal theory of recovery and even if we have been advised of the possibility of such damages.

Maximum Liability Cap

In no event shall our total liability exceed the total amount paid by the guest for the specific reservation giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from these Terms or your stay shall be resolved through binding arbitration in Ottawa, Ontario, unless otherwise prohibited by local law. Both parties agree to waive their right to a jury trial.

Mediation Process

Before initiating formal arbitration proceedings, parties agree to participate in good faith mediation to attempt to resolve disputes amicably. If mediation fails to produce a resolution within 60 days, either party may proceed to binding arbitration.

Modifications and Updates

We reserve the right to modify these Terms at any time without prior notice. Updated Terms will be posted on our website with a revised "Last Updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage guests to review these Terms periodically to stay informed of any changes.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any specific policies communicated at the time of booking, constitute the entire agreement between the parties and supersede all prior or contemporaneous communications and proposals.
